What Are the Terms of Domestic Violence Restraining Orders?
Also referred to as protection orders or orders of protection, restraining orders that are issued as part of domestic violence cases can come with various terms, depending on the circumstances involved.
In general, however, the terms of these orders can include (and may not be limited to) legal requirements that the person accused of domestic violence:
- Move out of the family home
- Stay away from the alleged victim’s work, school and/or any public place (s)he may regularly visit
- Refrain from contacting or communicating with the alleged victim(s) in person or via phone, text, email or other methods – This holds true regardless of whether the alleged victim(s) may have initiated the contact.
- Surrender any firearms to law enforcement authorities.

How Long Are Colorado Restraining Orders in Effect?
The restraining orders that automatically take effect after a domestic violence arrest are “temporary” orders, typically remaining in effect for short, distinct periods of time (like 72 hours to 14 days). An alleged victim can file a motion with the court to try to have these orders extended or be made permanent. When such motions are filed, there will be hearing to:
- Review the request
- Give the alleged perpetrator the opportunity to argue against the orders.
If permanent orders are imposed, these can last for a period of two years or longer. In some cases, these orders may come with lifetime restrictions.
What Are the Charges & Penalties Associated with Restraining Order Violations?
The charges and penalties associated with protective order violations will vary, according to whether the accused individual has prior convictions for violating restraining orders. Generally, a protection order violation is charged as a:
- Class 2 misdemeanor if there are no priors – These charges can be publishable by up to 1 year in jail and up to $1,000 in fines.
- Class 1 misdemeanor if there are priors – These charges can be publishable by up to 18 months in jail and up to $5,000 in fines.
Please note that these penalties can be imposed regardless of the disposition of the domestic violence case. In other words, you can still be charged with, convicted of and sentenced for a protective order violation even if the domestic violence charges that spurred the protective order are later dropped or the case ends in an acquittal.
What Happens If I Have Been Accused of Violating a Restraining Order in Colorado?
If someone calls the police to accuse you of violating the terms of a protective order, police will arrest you if they find probable cause to suspect that you have violated the order (with probable cause being reasonable grounds that a violation has occurred).
Following the arrest, the prosecutor will decide whether to file charges. If restraining order violation charges are filed, court proceedings will follow to determine whether the violation occurred.
